It shall be illegal for any person having control, custody, or ownership of a dog to allow a dog nuisance. The term "dog nuisance" shall mean:
A. Permitting any dog to habitually snap, growl, snarl, jump upon or otherwise threaten persons lawfully using any common thoroughfare, sidewalk, passageway, bypath, play area, park or any place where people congregate or walk;
B. The appearance of any dog that has previously been declared dangerous, vicious or menacing upon a public street or public area, or upon any premises other than those of the person owning such dog that is not wearing a muzzle securely fastened about its mouth in such a manner that it cannot bite, and is on a leash securely fastened to a collar or harness. The overall length of the leash including the handle shall not exceed six feet (6'), and be held by its owner or other person able to control such dog;
C. A dog which, because of noise, odor, disease, or other unwholesome factors, is offensive, harmful, or injurious to the public health, comfort, or welfare;
D. The accumulation of dog feces or other dog waste in any yard, pen, or premises in or upon which a dog shall be confined;
E. The failure of any person having custody, control, or ownership of a dog to remove feces deposited from said dog, except guide dogs, upon the public ways or within the public places of the village, or upon the premises of any person other than the owner without the person's consent;
F. Permitting any dog to howl, yelp, whine, bark or make noise in such a manner as to disturb the peace of any person or neighborhood;
G. Maintaining more than four (4) dogs over the age of four (4) months, unless as a licensed kennel;
H. A vicious or dangerous dog that is not kept, harbored, maintained, owned, or possessed within the corporate limits of the Village in strict conformance with the provisions of this chapter; or
I. A dog otherwise in violation of this chapter. (Ord. 2016-12-28, 12-1-2016)
